General Terms and Conditions (GTC)

1. Scope of Application

These General Terms and Conditions (GTC) apply to all services, products, and digital offerings of Viavestra GmbH, located at Eichmattstrasse 26, CH-6330 Cham (hereinafter referred to as the “Provider”).
They apply to all users of the services offered, regardless of whether the use is subject to a fee or free of charge.

Deviating, supplementary, or conflicting terms and conditions of the user shall only be recognised if the Provider has expressly agreed to them in writing.

2. Services of the Provider

3. Participation in Forms, Competitions, and Digital Campaigns

3.1. The use of the forms provided or participation in competitions is voluntary. By participating, the user agrees that their details may be processed for the purpose of handling their enquiry, making contact, and forwarding to relevant partner companies.

3.2. Participation in competitions does not entitle the user to a prize. The selection of winners is carried out according to the procedure described in the respective competition. Legal recourse is excluded.

3.3. Entries with obviously false information, multiple participations, or technical manipulation will result in exclusion from the activity.

4. Conclusion of a Contract

A contract is concluded as soon as the user actively uses a service of the Provider, for example by completing a form, subscribing to a newsletter, participating in a competition, or by commissioning an individual service in writing.

5. Obligations of the User

5.1. The user undertakes to provide all data transmitted in the course of use completely, correctly, and truthfully.

5.2. Misuse of the platform, such as entering third-party data, circumventing form restrictions, or deliberate technical manipulation, is prohibited and may result in legal consequences.

5.3. The user is obliged to ensure that their access data (e.g. for logins or queries) is kept secure and not made accessible to third parties.

6. Data Protection and Data Disclosure

6.1. The processing of personal data is carried out in accordance with the Swiss Data Protection Act (revDSG).

6.2. The user agrees that their data may be passed on to carefully selected partner companies, insofar as this is necessary for the fulfilment of the requested service – e.g. for the preparation of offers, advice, or further contact.

6.3. The current privacy policy of the Provider, available on the same domain, applies and forms part of these GTC.

7. Use of External Tools

The Provider uses various external services and platforms to optimise its offering, including but not limited to:

These tools may, in some cases, transfer data to countries outside Switzerland or the EU. Care is taken to ensure that appropriate safeguards for an adequate level of data protection are in place (e.g. through standard contractual clauses).

8. Disclaimer of Liability

8.1. The Provider does not guarantee the availability or error-free functionality of the services offered.

8.2. The Provider is not liable for content, offers, or services of third parties, in particular not for the content of linked websites or for the offers of affiliated partner companies.

8.3. Any liability for direct or indirect damages, consequential damages, or loss of profit arising from the use or unavailability of the services is excluded to the extent permitted by law.

9. Copyright and Intellectual Property

All content, designs, texts, logos, and media on the Provider’s online platforms are protected by copyright and may not be copied, modified, reproduced, or distributed without express permission.

10. Contract Duration and Termination

Contracts for individual services (e.g. digital advertising campaigns) are valid for the agreed term. Termination must be made in writing and in compliance with the agreed notice periods.
Free services such as newsletter subscriptions or competition participation can be revoked or cancelled by the user at any time.

11. Amendments to the GTC

The Provider reserves the right to amend these GTC at any time. The current version will be published on the website. Users will be informed of significant changes by email or in another appropriate manner.

12. Place of Jurisdiction and Applicable Law

These GTC and all contractual relationships with the Provider are governed exclusively by Swiss law.
The place of jurisdiction, to the extent permitted by law, is the registered office of the Provider.
